In the court below, Urie J.A. appears to have taken greatest exception to the linkages made by the Board between various concepts inherent in the definition.  Specifically, the Board linked the claimant's unwillingness to the state's inability to protect, and tied the former concept to the well-foundedness of the fear of persecution.  These appear to be unobjectionable propositions.  The problem for Urie J.A. arose from the Board's conclusion that a lack of state protection creates a presumption of persecution and well-foundedness of the claimant's fears.  Although not cited, the Board's expression of this presumption is taken almost verbatim from Goodwin-Gill, supra, at p. 38.

The master of the Marie Skou was on the bridge with the second officer and a lookout. He sighted the Chitose Maru by radar when still outside the six-mile range at 15 minutes past midnight bearing to starboard and he instructed the second officer to watch the echo. This the latter did, placing a bearing marker through it and he observed that the angle was altering to starboard. At 0019, the captain noted on a pad that the echo was at 5.5 miles bearing 10° to starboard. At 0025, he noted the distance as 2.5 miles and the bearing 15° to starboard. At 0029, the lookout from the wing of the bridge reported a white light to starboard 20° or a little more. The master went to the wing and with binoculars saw two masthead lights open to starboard. Then the white lights began to close showing the vessel was turning to starboard across the bow of the Marie Skou and in a few seconds the port light was seen. At 0030, at the same time as the wheel was swung hard to port, the engine was ordered to stop and then full speed astern. Two minutes later the collision occurred, the bow of the Marie Skou hitting the port side of the Chitose Maru, not very far aft of the bow and almost perpendicularly.

This entailed leaving Palmerston on County Road No. 5 which ran approximately straight north and which came into Provincial Highway No. 9 a very short distance, perhaps less than a mile, south of the Town of Harriston. The plaintiff delivered the young lady to her home and spent some time sitting in conversation with her outside her home then left to return to Milverton where he intended to spend the night evidently with his friend. The young lady had warned him that he should watch for the right-hand turn from Highway No. 9 onto County Road No. 5 just south of Harriston but as he drove south on Highway No. 9 he missed the turn. The plaintiff almost immediately thereafter arrived at the scene of the construction, noticed the road was getting rough and observed only one sign, that is a sign upon which he noticed the word “Detour”. Although the plaintiff stated he did not notice it, that sign also bore the words “1000 feet” below the word “Detour”.
