Le Règlement CEE no 1408/71 (les régimes de sécurité sociale et la libre circulation des personnes) relatif à l'application des régimes de sécurité sociale aux travailleurs salariés et aux travailleurs non salariés et aux membres de leurs familles qui se déplacent à l'intérieur de la Communauté, et le Règlement (CEE) no 574/72 du Conseil fixant les modalités d'application du règlement (CEE) no 1408/71, assurent que tout individu qui a exercé son droit à la libre circulation et le droit de résidence prévus par la législation européenne ne se trouve pas dans une situation moins favorable que celle d'une personne qui a toujours vécu et travaillé dans un seul Etat membre.

At the European level, the term “social security” means the service systems of the Member States provided upon the occurrence of one of the following: sickness and maternity, accidents at work and occupational diseases, old-age, disability and death (services to survivors) and unemployment. Family services are also included. REGULATION (EEC) No. 1408/71 on the application of social security schemes to employed persons and their families moving within the Community and Regulation (EEC) No. 574/72 fixing the procedure for implementing Regulation (EEC) No. 1408/71, ensure that anyone who has made use of the right to free movement and right of residence does not find him/herself in a worse position than someone who has always lived and worked in one single Member State. However, this does not affect the national social security systems; each Member State decides what its social security system grants, under what conditions, and in what amount.

Izraz socialna varnost na evropski ravni pomeni sistem socialnih storitev v državah članicah, ki so na voljo ob bolezni in materinstvu, nesreči pri delu in poklicnih boleznih, starosti, invalidnosti, smrti (pomoč preživelim) in brezposelnosti. Sem se uvrščajo tudi storitve za družine. Uredba Sveta (EGS) št. 1408/71 o uporabi sistemov socialne varnosti za zaposlene osebe in njihove družinske člane, ki se gibljejo v Skupnosti, in Uredba Sveta (EGS) št. 574/72, ki določa postopek za uvedbo Uredbe Sveta (EGS) št. 1408/71, zagotavljata, da posameznik, ki uresniči pravici do svobodnega gibanja in bivanja, ni v slabšem položaju kot posameznik, ki je vedno živel in delal samo v eni državi članici. To ne vpliva na sisteme socialne varnosti držav članic, saj se vsaka sama odloča o tem, kaj zagotavlja njen sistem, pod kakšnimi pogoji in v kakšnem obsegu.
