The performance bond can additionally be assumed as a dependent guarantee within a specific guarantee. It then serves to strengthen and extend contractual rights, and can also provide liability without fault. However, there is also an independent guarantee by means of which a guarantee is adopted for circumstances which go beyond the success as stipulated by the contract. This kind of independent guarantee can, in particular, be assumed by a third party in a special guarantee contract, for instance as a promise of the minimum durability, or the promise of the loading capacity or construction materials used as provided by the manufacturer.

Elle sert alors à renforcer et étendre les droits contractuels, et peut également inclure une garantie ne tenant pas compte de la responsabilité. Il existe cependant également une garantie indépendante avec laquelle est prise une garantie pour les circonstances qui outrepassent la réalisation due au contrat. Une telle garantie indépendante peut être prise notamment pas un tiers dans un contrat de garantie particulier, par exemple comme assurance d'une date limite d'utilisation ou comme assurance pour la résistance de matériaux de construction utilisés par le fabricant.

Die Erfüllungsgarantie kann als unselbständige Garantie im Rahmen eines bestimmten Vertrages zusätzlich übernommen werden. Sie dient dann der Verstärkung und Erweiterung vertraglicher Rechte und kann auch eine verschuldensunabhängige Haftung vorsehen. Es gibt aber auch die selbständige Garantie, mit der eine Gewähr für Umstände übernommen wird, die über den vertraglich geschuldeten Erfolg hinausgehen. Eine solche selbständige Garantie kann insbesondere auch von einem Dritten in einem besonderen Garantievertrag übernommen werden, zum Beispiel als Zusicherung einer Mindesthaltbarkeit oder Zusicherung der Belastbarkeit der verwendeten Baumaterialien durch den Hersteller.

Гарантия исполнения контракта также может быть использована в качестве несамостоятельной гарантии в рамках определенного договора. В таком случае она служит для усиления и расширения договорных прав и может предусматривать ответственность, независимую от вины участника договора. Но также существует и самостоятельная гарантия, с помощью которой обеспечиваются случаи наступления определенных обстоятельств, выходящих за рамки выгоды, предусмотренной договором. Подобная самостоятельная гарантия может быть востребована, в особенности со стороны третьих лиц, в рамках отдельного договора гарантии, например в качестве гарантии минимального срока хранения или гарантии предельно допустимой нагрузки применяемых производителем строительных материалов.
