The Embassy of Canada in Kinshasa organized a round-table discussion with non-governmental human rights advocacy organizations with a view to stimulating thinking and creating an open, productive dialogue about the development of human rights in the DRC.

I have been working in the international development field since 1998 and have worked with conflict- affected communities, focusing on youth in Latin America, Asia and Africa. In that time, I’ve lived and worked in the Philippines, Tajikistan, Ecuador, Guatemala, Peru, Nepal, Cuba, the DRC, Northern Uganda, Ethiopia, South Sudan and Burkina Faso. My areas of expertise include education, community development and livelihoods. I have had the opportunity to work extensively with small local community development organization abroad as well as with the UN. Now based in Canada I have been working with both small and large Canadian NGO’s with projects overseas.

People also remember the American role in the capture of Patrice Lumumba and currently there are issues with surrounding countries since they have invaded DRC in the past years. Most of them are gone again, but especially with Rwanda and Uganda, tensions are present. The Sominki, created in 1976 from the merger of several companies, was the main mining company working in Kivu through the late 1970s to early 1990s. In late 1995, Banro Corporation acquired the SOMINKI with its 12 gold concessions and 35 tin concessions. By January 1996, Banro was a majority shareholder (72%) with the Zaire state holding the balance of the shares. In February 1997, BANRO and the Zaire government signed the Mining Convention. The result was the creation of SAKIMA SARL (93% Banro) to take over the mining projects.

In October 2002, the Second UN Panel of Experts Report on Illegal exploitation of natural resources and other riches in the Democratic Republic of Congo (DRC) included an annex listing companies which, in their view, violated the Guidelines. In October 2003, the UN published a subsequent report in which seven of the eight Canadian companies were listed as issues "resolved - no further action required." One company was listed as "Pending Cases with Governments". The NCP accepted the Panel's conclusions and followed up with the "eighth" company Kakanda Development Corporation. In response to the NCP's follow-up actions, the company replied with a letter describing their involvement in the DRC. The letter indicated that the company had not been active in the DRC since 1997 and they had officially halted all activities in the DRC as of June 4, 2004. The NCP subsequently brought this case to a close as a specific instance procedure.

The security situation in the DRC remains a matter of concern with several armed groups active in different regions of the country. People continue to be displaced and sexual violence against women and girls remains a problem. According to the Office for the Coordination of Humanitarian Affairs, as of May 2017, there were more than 3,700,000 internally displaced persons in the DRC.

Your Cultural Interpreter was born in Kinshasa, the capital city of the Democratic Republic of Congo (formerly Zaire), the third of four children. He grew up in the city and obtained a secondary school diploma in Biochemistry at the Institut du Mont-Amba in Kinshasa. Due to the political situation, he immigrated to Canada in 1993 to study and earned a BA in Computer Science. He has lived in Ottawa since 1995 and works in the high-tech sector. He is married and has one child.

In consultation with those NCPs, it was determined that the Canadian NCP was the designated NCP to take on this case given that the Company is a Canadian multinational and that the allegations are about its activities in the DRC, a country which is non-adherent to the OECD Guidelines and therefore that does not have an NCP.
