LUCHA est un mouvement de jeunesse apolitique formé dans l'est de la République Démocratique du Congo qui lutte contre la corruption chronique et l'impunité en RDC. Bien qu'il s'est d'abord concentré sur des questions locales telles que l'accès à l'eau potable, l'électricité et le chômage des jeunes, le mouvement s'est transformé en six ans seulement en un vaste réseau national d'organisateurs sociaux très influents.

LUCHA es un movimiento juvenil apolítico formado en la República Democrática del Congo oriental que lucha contra la corrupción crónica y la impunidad en la RDC. Aunque inicialmente se centró en cuestiones locales como el acceso a agua potable, electricidad y el desempleo juvenil, en solo 6 años el movimiento se ha convertido en una extensa red nacional de organizadores sociales muy influyentes. Las protestas y manifestaciones pacíficas lideradas por LUCHA son habitualmente reprimidas por las autoridades. En octubre de 2017, 5 jóvenes manifestantes fueron asesinados durante una manifestación organizada por LUCHA, y muchos de sus miembros y líderes fueron arrestados/as y detenidos/as durante reuniones pacíficas. La agencia nacional de inteligencia congoleña detuvo a varios miembros que sufrieron abusos físicos y psicológicos durante su detención.

Après un premier échec d’un avant projet de loi en 2007, un nouveau projet de loi portant promotion et protection des défenseurs des droits de l'homme en RDC a été présenté à l'Assemblée nationale de la RDC en 2011 avec le soutien du ministre de la Justice de l’époque.

After an initial law draft to protect human rights defenders in the DRC was rejected in 2007, a new bill was presented to the DRC’s National Assembly in 2011 with the support of the acting Minister of Justice. Yet according to Roger, “This law initiative has not yet been adopted and is nearing a dead end. It was initially rejected due to claims that other legislative devices already exist protecting human rights defenders and therefore making them a specific category to protect would be unconstitutional.”

Les intervenants à Bruxelles et à la Haye ont beaucoup apprécié la visite de M.Muchuba et l’ont invité à travailler en plus étroite collaboration avec leurs partenaires en RDC. En ce qui concerne l’amélioration du projet de loi en question, M. Muchuba a mis en exergue l'importance «d’une bonne lecture du projet de loi et un bon plan d'implication de tous les acteurs de la société civile, y compris les députés, qui sont disposés à apporter un soutien au processus de rédaction de la loi.» Cette approche s’est avérée fructueuse dans d'autres cas analogue concernant la loi spécifique, comme celle qui protège les autochtones pygmées.

Stakeholders in Brussels and The Hague were very appreciative of Roger’s visit and invited him to work closely with international partners in the DRC. In terms of conceiving an improved law proposal protecting human rights defenders, Roger underlined the importance of implicating all actors of civil society – including policy makers and national members of Parliament – in the drafting process. “Such an approach has seen success in cases similar to ours concerning a specific law like that protecting indigenous Pygmy populations” explains Roger, “At the same time, it will be important to follow neighbouring countries’ experiences like in Burundi and Côte D’Ivoire, and even learn from similar experiences in Latina America.”

Bruxelles, Belgique - La semaine dernière l’équipe de Protection International (PI) a eu le plaisir de recevoir Roger Muchuba à Bruxelles de la nouvelle antenne de PI à Kinshasa. Depuis mai 2014, M. Since May 2014, Roger has been researching primary factors influencing protection of human rights defenders as well as a related law initiative in the DRC, and spent last Thursday and Friday August 21-22 meeting with high-level officials and organisations in Brussels and The Hague and briefing them on the situation.

Ultimately, those responsible must be brought to justice. Recognising those who died trying as HRDs and a better administration of justice are critical steps to end these killings.
