One of the insured companies (Stolberg Mill Construction Ltd.) had a contract to erect a warehouse and the appellant on behalf of the company was supervising the construction of the building. On April 7, 1965, the warehouse collapsed, resulting in the death of one K, an employee of the construction company.

Une des compagnies assurées (Stolberg Mill Construction Ltd.) s’était engagée par contrat à construire un entrepôt et l’appelant surveillait la construction pour le compte de la compagnie. Le 7 avril 1965, l’entrepôt s’est écroulé, entraînant la mort de K, un employé de ladite compagnie. La veuve de K a poursuivi l’appelant pour négligence et le jugement prononcé en l’instance a condamné ce dernier à payer $75,000 et les dépens.
