The information on this form is required for the purpose of providing a security screening assessment. It is collected under the authority of subsection 7(1) of the Financial Administration Act and the Policy on Government Security (PGS) of the Government of Canada, and is protected by the provisions of the Privacy Act in institutions that are covered by the Privacy Act. Its collection is mandatory. A refusal to provide information will lead to a review of whether the person is eligible to hold the position or perform the contract that is associated with this Personnel Screening Request. Depending on the level of security screening required, the information collected by the government institution may be disclosed to the Royal Canadian Mounted Police (RCMP) and the Canadian Security Intelligence Service (CSIS), which conduct the requisite checks and/or investigation in accordance with the GSP and to entities outside the federal government (e.g. credit bureaus). It is used to support decisions on individuals working or applying to work through appointment, assignment or contract, transfers or promotions. It may also be used in the context of updating, or reviewing for cause, the reliability status, security clearance or site access, all of which may lead to a re-assessment of the applicable type of security screening. Information collected by the government institution, and information gathered from the requisite checks and/or investigation, may be used to support decisions, which may lead to discipline and/or termination of employment or contractual agreements. The personal information collected is described in Standard PIB PSU 917 (Personnel Security Screening) which is used by all government agencies, except the Department of National Defence PIB DND/PPE 834 (Personnel Security Investigation File), RCMP PIB CMP PPU 065 (Security/Reliability Screening Records), CSIS PIB SIS PPE 815 (Employee Security), and PWGSC PIB PWGSC PPU 015 (Personnel Clearance and Reliability Records) used for Canadian Industry Personnel. Personal information related to security assessments is also described in the CSIS PIB SIS PPU 005 (Security Assessments/Advice).

Drugs regulated under schedules 1-5 of the CDSA were sent to a Queen's warehouse and were subsequently improperly disposed of (garbage/landfill). These drugs included steroids, methadone, catha edulis, marihuana, hash, coca leaf tea, and contaminated drug paraphernalia. The audit could not perform a similar review in the other Queen's warehouses because descriptions were vague ("1 ctn meds") or because officials at the warehouses did not provide the requested inventory report. Drugs (seized and detained) regulated under schedules 1-5 of the CDSA must be turned over to the RCMP because only the RCMP is authorized by Health Canada to destroy these substances. The audit noted that employees working in Queen's warehouses could not recognize drugs regulated under schedules 1-5 of the CDSA and did not know they should not destroy these drugs.

The Canada Customs and Revenue Agency (CCRA) entered into memoranda of understanding (MOUs) with several federal and provincial departments and agencies for the exchange of information and joint administration of various acts and/or regulations. It was agreed that organizations, under the provision of an MOU, were to conduct internal audits, within two years of signing the agreement, ensuring that there were adequate controls over the exchange of information. Some organizations, such as the Royal Canadian Mounted Police (RCMP), required the CCRA to complete reciprocal audits. The Policy and Planning Branch (formerly Policy and Legislation Branch) was responsible for maintaining MOUs in CCRA.

The Customs Enforcement Manual provides detailed guidance on the seizure process and it was electronically available to CBSA offices. Guidance on facility construction of bond rooms, Queen's warehouses and fenced areas was included in CBSA publications, such as the Land Border Design Guide 2003, and in RCMP physical security publications.

The CBSA and U.S. CBP conduct risk assessments of applicants simultaneously using law enforcement, customs and immigration databases. Law enforcement screening includes Canadian Police Information Centre and U.S. National Crime Information Centre database checks. FAST commercial drivers are fingerprinted and the prints are forwarded to the RCMP for analysis. Meanwhile, although the drivers can already be enrolled in FAST, should there be a disqualifying hit against the RCMP's database, the driver's card would be revoked, and if the applicant is not yet enrolled, the applicant would have to reapply.

An audit test was performed on the procedures in place to ensure that all persons accessing RCMP information have the appropriate security clearances. The audit found instances where employees had access to CPIC information without having the appropriate level of security clearance. The RCMP section in charge of CPIC demands that clearances to the secret level be obtained, with the appropriate check of fingerprints against existing criminal records, before access is granted to the CPIC system. When Customs asks for this level of clearance, including the fingerprinting requirement, from the RCMP, the requests are risk ranked and a fingerprint review is not always completed.

The Comptrollership Manual, Security Volume, Chapter 11, "Security Design of Canada Border Services Agency Facilities," was published electronically and was available, but it did not specifically discuss bond rooms or Queen's warehouses. In addition, there was no electronic link to the Appendix A, "Physical Security Standards and Design Specifications Guide." There was a link to RCMP security policies, but the application of RCMP lead agency policies to the CBSA environment, such as to bond rooms and Queen's warehouses, would not be evident to an uninformed person.

When Policy and Legislation Branch, CCRA, was asked to provide a listing of MOUs signed with the RCMP, they identified a total of eighteen. A check with the RCMP revealed that they were holding what they believed were 56 MOUs signed with the CCRA. It was determined that the principal cause for this discrepancy was the lack of a clear definition between the two organizations of what constituted an MOU for exchange of information. It is important from a control standpoint for the two organizations to have lists that agree and to clarify the definition of an MOU.

The CBSA concurs with this recommendation. The Admissibility Branch, in consultation with the Enforcement Branch, will review the current risk assessment process to identify potential gaps by October 2008. The CBSA will explore measures to ensure that the system used in the ECs can query the entire FOSS database for previous immigration violations, as it does for customs hits in ICES. Currently, ICES and FOSS only query a small portion of the FOSS database. Recently, a manual process was implemented that enables immigration officers to search the full FOSS database for all enforcement actions. The fingerprinting of applicants complements database screening. Both the FBI and the RCMP vet the fingerprints of FAST commercial driver applicants while NEXUS applicant fingerprints are only vetted by the FBI.

While most people who come to Canada on a temporary basis leave Canada when they are required to do so, a small number remain illegally. In addition, a small percentage of migrants enter Canada using fraudulent travel and identity documents. Offences may also be perpetrated by both employers or immigration consultants who help migrants gain entry by fraudulent means. Furthermore, there are irregular migrants (e.g. Improperly Documented Arrivals) who enter Canada surreptitiously, both at and between ports of entry to either enter refugee claims or go underground. Such activities present serious challenges to the integrity of Canada's border legislation, the integrity of the immigration program, and to the safety and security of Canadians.

Preliminary observations indicate that the individual INSETS have had success in disrupting terrorist activities, but the evaluation could not confirm the Teams' effectiveness independently. Agency and INSET management are satisfied with Customs' participation in the INSETS during periods of imminent security threats. There is a misunderstanding, however, concerning Customs' role in on-going investigations. INSET management want Agency officers to be active team members on investigations, while the Agency prefers that assigned officers function largely as liaison officers to the INSETS.

Funding has not yet been provided for CBSA's participation in the INSET program, but is under consideration. In the interim, there has been agreement with the Royal Canadian Mounted Police (RCMP) on part-time/interim participation in the INSETs. Since fall 2005, all PIP RIOs must attend a four-day physical security course offered by the RCMP, as well as the annual five-day PIP conference. A course on giving oral presentations is now also obligatory.[ 18 ] Most RIOs interviewed indicated that this training program is adequate, providing them with the knowledge they need to deliver the PIP program as it is currently designed. There is limited evidence available to corroborate the officers' perceptions of the training, but the partner survey results do indicate that 83% of PIP participants are "very satisfied" or "somewhat satisfied" with the level of knowledge of the CBSA officers assigned to work with them, with only 3% "somewhat dissatisfied" or "very dissatisfied."[ 19 ]

The 1991 Ministerial Directive (MD) outlining enforcement roles and responsibilities of the Royal Canadian Mounted Police (RCMP) and Canada Customs had caused concern within CCRA regarding the division of responsibilities between the RCMP and Customs Investigations. The Contraband and Intelligence Services Directorate (CISD) was responsible for administering the MD and, as a result, was responsible for assigning referrals to either the RCMP or Customs Investigations. The situation had caused some disparity between Investigations and CISD on the appropriate assignment of referrals.

The IBETS have produced few enforcement results to date. Until 2003, there was little effective management direction provided to the individual IBETS, inadequate application of the "intelligence-led" concept, and insufficient focus on key priorities of national security and organized crime. Lack of shared accommodations and limited US participation has reduced interoperability of the units. All these problems have been acknowledged, and steps taken to rectify them. The measures taken show promise for improvement in IBET performance over time.

Management agrees that the division of responsibilities between the CBSA and the RCMP needs to be clarified, especially in light of a number of changes within Customs since the 1991 MD. This issue was the subject of a lengthy review by CBSA managers and has already been the subject of extensive discussions with the RCMP within the National Headquarters Consultative Committee. Accordingly, a new ministerial directive clarifying CBSA and RCMP roles will be necessary. A working group consisting of managers and directors from Headquarters and the field has been convened to explore issues relating to the Ministerial Directive regarding the Division of Responsibilities between Customs Investigations and the RCMP.

Oversight of CBSA's JFOs participation is provided primarily at the regional level. CBSA managers and officers interviewed indicated that regional managers monitor officer activities on JFOs on a regular basis to ensure effective use of time, that activities align with the CBSA mandate and that information sharing requirements as stipulated in Section 107 of the Customs Act andthe Privacy Act Section 8(a)are respected. Managers in the regions reported that balancing JFO participation against the need to provide intelligence support to the PoEs and fill requests from NHQ to participate in national or special projects is challenging. Regional managers stated that additional NHQ direction in terms of priorities for intelligence resource deployment would be of benefit in making these decisions.

All interviewees who were asked the question agreed that there is a need for vehicle markings in most situations. Moreover, most felt that clear marking of vehicles to make them more easily and readily identifiable was crucial for health and safety reasons, particularly for those working at the Ports of Entry (POEs). In some cases, vehicle markings are also deemed mandatory due to the environment in which the vehicles operate. For example, one region reported that the airport authority requires that all vehicles with restricted access be identified by the company logo or company name on both sides of the vehicle prior to travelling airside.

The Intergovernmental Relations Division within the International Partnerships Directorate recently conducted a joint review with the RCMP of the CBSA and RCMP relationship.[ 33 ] The review found that "CBSA's relationship with the RCMP is mainly managed at the working level [and] there is no formal forum or structure at the highest level to discuss key strategic policy objectives".In the absence of a CBSA JFO policy, clarification of common CBSA and RCMP objectives would help provide a framework for decisions concerning participation on RCMP led-JFOs.

NHQ's ongoing involvement in JFOs is limited to Integrate Border Enforcement Team (IBET) and Border Enforcement Security Task Force (BEST). Support to IBET is mainly through a CBSA liaison advisor who serves as a member of the IBET International Coordination Team (ICT). With respect to BEST, the Criminal Investigations Division (CID) monitors activities of CIs assigned to BEST units and reports to senior management at NHQ on issues relate to CBSA participation. For other JFOs, headquarters support is limited to addressing ad hoc requests for guidance from the regions, and managers at NHQ indicated a need for greater involvement in determining whether CBSA resources should be dedicated to specific JFOs.
