Le Plaignant représente 14.000 réfugiés éthiopiens ayant fui l‘Ethiopie avant 1991, sous le régime Mengistu et qui ont vécu au Soudan avant d‘être rapatriés de force en vertu d'une décision adoptée par l'Etat défendeur et le Haut Commissariat des Nations Unies pour les réfugiés (UNHCR) en septembre 1999.
