It was also stated that it was clear from their provisions that the EOs were governed by the principle of minimal intervention in the sovereign rights of the extension states. The Convention, on the other hand, was based inter alia on the delegation of national sovereign rights to the EPO, on the participation and the controlling function of the Administrative Council in the administration of the EPO, and on the division of renewal fees between the EPO and the contracting states involved.

La chambre a également déclaré que les dispositions des décrets d'extension montraient clairement que ceux-ci sont régis par le principe selon lequel il convient d'intervenir le moins possible dans les droits souverains des Etats autorisant l'extension. La Convention, quant à elle, se fonde notamment sur la délégation de droits souverains nationaux à l'OEB, sur la participation du Conseil d'administration à l'administration de l'OEB et à son contrôle, ainsi que sur la répartition des taxes annuelles entre l'OEB et les Etats contractants concernés.

Wie die Kammer weiter ausführte, lassen die Bestimmungen klar erkennen, dass die Erstreckungsverordnungen von dem Grundsatz beherrscht werden, dass in die Hoheitsrechte der Erstreckungsstaaten möglichst wenig eingegriffen werden soll. Demgegenüber beruhe das Übereinkommen unter anderem darauf, dass nationale Hoheitsrechte auf das EPA übertragen werden, dass der Verwaltungsrat an der Verwaltung des EPA mitwirkt und diese kontrolliert und dass die Jahresgebühren zwischen dem EPA und den beteiligten Vertragsstaaten aufgeteilt werden.
