Decision review – Section 27 of the Public Service Staff Relations Act (PSSRA) – Appropriateness of the bargaining unit – Effect of the Canadian Human Rights Act (CHRA) – the employer requested a review of five decisions determining that five separate bargaining units were appropriate for collective bargaining: 143-13-153 and 156 (August 21, 1975); 146-13-154 (August 21, 1975); 143-13-157 (August 21, 1975); 143-13-158 (August 21, 1975); 142-13-294 (June 3, 1991), (1991) 19 PSSRB Summaries 2 – the employer was seeking to have those five bargaining units amalgamated into a single unit – the Public Service Alliance of Canada (PSAC) was the bargaining agent for four of these bargaining units, comprising approximately 90% of the employer's workforce, and the Professional Institute of the Public Service of Canada (PIPSC) was the bargaining agent for the remaining bargaining unit which was comprised of engineers – the PIPSC opposed the application – the PSAC did not oppose the application insofar as it related to the four bargaining units which it represented and it took no position in relation to the bargaining unit represented by the PIPSC – the evidence established that the employer was in the process of developing a universal job evaluation system for its non-executive employees, using the factors outlined in section 11 of the CHRA – in support of its application, the employer referred to section 33 of the PSSRA dealing with certification, which requires that any bargaining unit must be co-extensive with the employer's classification plan, unless such a bargaining unit would not permit satisfactory representation – according to the employer, only a single bargaining unit would accommodate its universal job evaluation system – the Board agreed with this argument and concluded that, while other criteria might be important in assessing whether or not the existing bargaining unit structure should be reconfigured, the requirements of section 11 of the CHRA played a paramount role – accordingly, the Board determined that one bargaining unit was appropriate for collective bargaining and that it would be represented by the PSAC.

It having been recognized that linear defences like the trench lines of the Great War would be unable to withstand a modern attack, British doctrine during the Second World War prescribed a system of defended localities where the ground commanding a given area would be manned by infantry and their supporting arms, setting up positions of all-round defence to prevent the enemy from moving through that area. A mobile reserve was to be maintained to counter-attack any enemy penetration. Front line positions, therefore, were not continuous as in the earlier war, but fluid and mutually-supporting. As with the selection of objectives in the attack, defensive positions were determined in accordance with the anti-tank plan. Defensive methods included, aside from the obvious weapons fire, concealment and camouflage to gain surprise, use of ground-particularly reverse slope positions-to allow freedom of movement without fear of enemy observation, deception techniques such as the use of "dummy" defences, observation posts to gain information about the enemy, outpost lines forward of main defences to create depth, and the building of obstacles covered by fire, such as minefields or anti-tank barriers, to channel the enemy into areas more favourable to the defenders, the goal being to "[lead] the enemy into areas where he can most effectively be destroyed" (War Office training manual, 15 January 1944).

Révision d'une décision - Article 27 de la Loi sur les relations de travail dans la fonction publique (Loi) - Habilité de l'unité à négocier collectivement - Effet de la Loi canadienne sur les droits de la personne (L.C.D.P.) - l'employeur a demandé un réexamen de cinq décisions dans lesquelles la Commission avait conclu que cinq unités de négociation distinctes étaient habiles à négocier collectivement : 143-13-153 et 156 (21 août 1975); 146-13-154 (21 août 1975); 143-13-157 (21 août 1975); 143-13-158 (21 août 1975) et 142-13-294 (3 juin 1991), [(1991) 19 Résumés de la CRTFP 2] - l'employeur cherchait à faire fusionner cinq unités de négociation en une - l'Alliance de la Fonction publique du Canada (Alliance) était l'agent négociateur de quatre de ces unités de négociation, qui formaient environ 90 % de l'effectif de l'employeur, et l'Institut professionnel de la fonction publique du Canada (Institut) était l'agent négociateur de l'unité de négociation restante, qui était formée d'ingénieurs - l'Institut s'est opposé à la demande - l'Alliance ne s'est pas opposée à la demande concernant les quatre unités de négociation qu'elle représentait et elle n'a pas pris parti relativement à l'unité de négociation représentée par l'Institut - il est ressorti de la preuve que l'employeur était en train d'élaborer un système général d'évaluation des emplois pour ses fonctionnaires qui ne font pas partie du groupe de la direction en utilisant les facteurs énoncés à l'article 11 de la L.C.D.P. - à l'appui de sa demande, l'employeur a cité l'article 33 de la Loi, qui porte sur l'accréditation et dit que toute unité de négociation doit correspondre au plan de classification de l'employeur à moins que l'unité de négociation ne permette pas une représentation adéquate des fonctionnaires - d'après l'employeur, seule une unité de négociation unique permettrait de répondre aux besoins de son système général d'évaluation des emplois - la Commission a souscrit à cet argument et a conclu que, si d'autres critères peuvent avoir leur importance lorsqu'il s'agit de déterminer si la structure actuelle devrait être modifiée, les exigences de l'article 11 de la L.C.D.P. ont une influence déterminante - par conséquent, la Commission a déterminé qu'une seule unité de négociation serait habile à négocier collectivement et que cette unité serait représentée par l'Alliance.

Decision review – Section 27 of the Public Service Staff Relations Act (PSSRA) – Appropriateness of the bargaining unit – Effect of the Canadian Human Rights Act (CHRA) – the employer requested a review of five decisions determining that five separate bargaining units were appropriate for collective bargaining: 143-13-153 and 156 (August 21, 1975); 146-13-154 (August 21, 1975); 143-13-157 (August 21, 1975); 143-13-158 (August 21, 1975); 142-13-294 (June 3, 1991), (1991) 19 PSSRB Summaries 2 – the employer was seeking to have those five bargaining units amalgamated into a single unit – the Public Service Alliance of Canada (PSAC) was the bargaining agent for four of these bargaining units, comprising approximately 90% of the employer's workforce, and the Professional Institute of the Public Service of Canada (PIPSC) was the bargaining agent for the remaining bargaining unit which was comprised of engineers – the PIPSC opposed the application – the PSAC did not oppose the application insofar as it related to the four bargaining units which it represented and it took no position in relation to the bargaining unit represented by the PIPSC – the evidence established that the employer was in the process of developing a universal job evaluation system for its non-executive employees, using the factors outlined in section 11 of the CHRA – in support of its application, the employer referred to section 33 of the PSSRA dealing with certification, which requires that any bargaining unit must be co-extensive with the employer's classification plan, unless such a bargaining unit would not permit satisfactory representation – according to the employer, only a single bargaining unit would accommodate its universal job evaluation system – the Board agreed with this argument and concluded that, while other criteria might be important in assessing whether or not the existing bargaining unit structure should be reconfigured, the requirements of section 11 of the CHRA played a paramount role – accordingly, the Board determined that one bargaining unit was appropriate for collective bargaining and that it would be represented by the PSAC.

Instead, it hovers in an ambiguous intermediate state, between a criminal act and a gesture of generosity, and between Soutine and Riff 170.” Appropriately, Native now splits his time between Paris and Lagos.
